ghSMART Notice at Collection For California Candidates and Participants

This Notice at Collection is directed to candidates that we assess (“Candidates”) and other participants in an assessment (“Participants”) who reside in California, as required by the California Consumer Privacy Act of 2018 and its implementing regulations, as amended.  The Notice discloses the personal information that ghSMART may collect about you in the context of performing our assessments as well as certain other information to which you are entitled.

Categories of Personal Information Collected

In the course of performing our candidate assessment, we may collect the following categories of personal information about candidates, whether directly from the candidate or from someone else:

identifiers, gender, video and audio recordings of our interactions with you, education information, employment history, and professional information. We may also use such information to draw inferences about your characteristics, behaviors, attitudes, and aptitudes.

We will not ask you to identify your gender and we do not ask others about your gender. Rather, our professionals will note your gender based on your outward manifestations and on any statements you make during the assessment that clearly indicates your gender identity. We are cognizant of the fact that certain individuals identify as non-binary or transgender.

With respect to Participants, ghSMART collects identifiers. Most of the information we collect from Participants pertains to a Candidate that we are assessing.

ghSMART does not collect sensitive personal information.

Purposes for Which Personal Information is Collected / Used

We collect personal information at the request of our clients to perform assessments on candidates who are under consideration for specific employment positions. Our clients utilize such information in their evaluation of such candidates.

With respect to gender, ghSMART uses such information to conduct and publish research. Examples of research topics could include: (a) the manner in which females perform as compared to males in given scenarios, or; (b) the performance of categories of individuals in varying industries and/or private vs. public companies. When using personal information for research, ghSMART implements appropriate safeguards to ensure we use only that personal information necessary to undertake the research underway. Where possible, ghSMART conducts its research using personal information that is anonymised and/or aggregated. ghSMART does not disclose personal information of any specific Candidate through such research. Gender is not used in the assessment of Candidates or otherwise in the performance of services for our clients.

ghSMART does not sell or share personal information.

Retention of Personal Information

ghSMART retains personal information as required by legal and accounting standards and in compliance with our corporate records retention policy.  In some circumstances, we may aggregate or deidentify your personal information so that it can no longer be associated with you, in which case we retain such information indefinitely.
